Hi, it depends on what you agreed to in the contract. I’ll have to assume you’re in CA too. In CA, a termite inspection will have Section 1 and Section 2 items. Section 1 would cover active termites or dryrot. If your agreement only states that the seller is responsible for Section 1 items and there are none, I would advise the buyer they are more than welcome to treat the house after the close. Unless you have something in writing that states otherwise, I see no reason to treat a non-existent problem. However if the buyer is threatening to cancel the transaction if you don’t treat the house and the treatment cost is less than the headache of trying to find another buyer, then it may be worth doing.
